Some thoughts on PA Gov. Shapiro executive order on data centers --> 1) The State had a mechanism for expedited data center approvals. That is gone. 2) Developers need local approval before the state will issue a permit. DEP will still review in parallel, but nothing gets granted until local land use approvals are in hand. Previously the state process could get a head start and finish first. 3) New DCs now have to pay the full cost of the power and grid infrastructure they require, while meeting new water, labor and community requirements 4) State agencies can no longer sign NDAs. All of these seem broadly consistent with where Shapiro was already heading. This move is not as aggressive as Texas or New York, in the sense that there is no freeze on new energizations here.
